Terms of Service

IMPORTANT — PLEASE READ BEFORE USING OMMODE

Ommode is a research and validation project, not a commercial product or medical service. By using this platform you confirm that you have read, understood, and accepted these Terms of Service in full.

1. Nature of the Platform

Ommode is a beta test platform created to validate a sleep health programme developed by a neurologist and sleep disorder specialist. It is provided for research and evaluation purposes only.

Ommode is not a medical device, a diagnostic tool, or a substitute for professional medical advice, diagnosis, or treatment. It does not provide medical consultations, clinical assessments, or therapeutic recommendations in the clinical sense.

If you are experiencing serious sleep difficulties, a medical condition, or a mental health crisis, please consult a qualified healthcare professional.

2. Who Can Use Ommode

You must be at least 18 years old to use Ommode.

By creating an account, you confirm that:

• You are 18 years of age or older
• You are participating voluntarily and with full understanding that this is a test programme
• You are not using Ommode as a replacement for medical care
• The information you provide is accurate to the best of your knowledge

3. Beta Test Participation

By registering, you agree to participate in a structured beta test of the Ommode programme. This involves:

• Completing a sleep health questionnaire (onboarding)
• Logging your sleep daily for a 14-day tracking cycle
• Receiving personalised sleep recommendations and audio content based on your logged data

Your participation helps validate the programme's methodology and user experience. Your anonymised data may be used to improve the programme. It will not be sold, shared with third parties, or used for any commercial purpose.

4. Duration

This beta test programme runs for an initial period of 3 months from the date of your registration. Your participation may be extended beyond this period if you have not requested account deletion and the programme is ongoing. You will be notified if the programme ends.

You may stop participating at any time by requesting account deletion (see section 7).

5. No Commercial Relationship

Ommode is not a company, not a registered business, and not a commercial service. There is no subscription fee, no payment, and no commercial transaction involved.

The programme is operated by Dr. Tatiana Kukel in a personal and research capacity. No guarantees of service continuity, feature availability, or programme completion are made.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• Ommode and Dr. Tatiana Kukel accept no liability for any direct, indirect, incidental, or consequential damages arising from your use of the platform
• The programme is provided "as is" without warranty of any kind, express or implied
• We do not guarantee that the programme will be uninterrupted, error-free, or available at any particular time
• Recommendations generated by the platform are informational only and do not constitute medical advice

7. Account Deletion and Data Removal

You have the right to request the deletion of your account and all associated personal data at any time. To do so, contact:

Your data will be permanently deleted within 30 days of your request. You will receive a confirmation email when deletion is complete.

8. Modifications to These Terms

These terms may be updated from time to time. If changes are material, you will be notified by email. Continued use of Ommode after notification constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of Switzerland, specifically the Swiss Federal Act on Data Protection (nFADP) and applicable cantonal regulations. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.
